These Terms of Use ("Terms") govern your use of the FundMatched website and funnel ("Services"). By submitting the quote form, accessing our website, or otherwise engaging with FundMatched, you agree to be bound by these Terms.
FundMatched is a marketing company that connects real estate investors seeking business or investment-purpose financing with private capital and lending partners in our network, including hard money, bridge, DSCR, and other investment-property lending programs. FundMatched is not a lender, broker, or mortgage originator. We do not provide financial, lending, investment, legal, or tax advice, and we do not make any lending decision, set any rate or term, or guarantee funding.
Submitting a quote request does not guarantee that you will be matched with a lending partner, that any lending partner will contact you, or that any lending partner will approve, price, or fund your financing request. All financing decisions, underwriting, terms, and approvals are made solely by the applicable lending partner, not by FundMatched. Any timeline, speed, or "matched" language on our website or in our marketing describes how quickly we may connect you with a lending partner, not a commitment by any lending partner to fund your deal.
FundMatched does not charge investors any fee to submit a quote request or to be matched with a lending partner. Any fees, rates, points, or costs associated with an actual financing transaction are set solely by the lending partner and disclosed to you directly by that lending partner, not by FundMatched.
Our Services are intended solely for business or investment-purpose financing on non-owner-occupied investment property (fix and flip, bridge, DSCR rental, ground-up construction, and cash-out refinance). Our Services are not available for, and may not be used to seek, financing for the purchase or refinance of a primary residence.
Information you submit through our funnel or website is collected, stored, and processed in accordance with our Privacy Policy. By submitting the form, you consent to be contacted by FundMatched (by telephone, text, and email) and by the lending partner(s) we match you with (by telephone and email), as described in the consent language you agree to at submission and in our Privacy Policy. When we match you with a lending partner, we deliver your request to that partner so they can evaluate your financing and contact you directly about it; the consultation you book through our funnel is with a FundMatched advisor. Text messages come from FundMatched only, under its text-messaging program (see Section 6); your mobile number and text opt-in are used by FundMatched and are not shared with third parties for their own text-message marketing. You may opt out of FundMatched's texts at any time by replying STOP (reply HELP for help), or unsubscribe from emails using the instructions in our emails.
Program. FundMatched operates a text-messaging program that sends appointment confirmations, appointment reminders, and related customer-care and support messages to people who request a consultation through our quote form. Messages are sent by FundMatched only.
To the maximum extent permitted by law, FundMatched shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of our Services, including any decision made or action taken by a lending partner we match you with. Our total liability for any claim arising under these Terms shall not exceed one hundred dollars ($100).
All content on this website, including text, graphics, logos, and methodology, is the property of FundMatched and is protected by intellectual property laws. You may not reproduce, distribute, or use our materials without prior written permission.
These Terms are governed by the laws of the jurisdiction in which FundMatched is registered. Any disputes arising under these Terms shall first be addressed through good-faith negotiation, and if unresolved, through binding arbitration in that jurisdiction.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and FundMatched regarding the Services and supersede any prior representations, advertisements, or communications, whether written or oral.
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Services after changes constitutes acceptance of the updated Terms.
